Abstract

The establishment of a permanent international judiciary to which all Member States are subject, It came in response to the repeated voices calling for an end to the impunity of the perpetrators of international crimes and the establishment of their international responsibility, regardless of their characteristics and positions. In order to achieve international legitimacy and protect human rights.

Although the Court is a permanent and independent judicial organ, however, it still suffers from dependency and politicization. It also notes the shortcomings in the performance of its tasks due to restrictions created by its statute itself, represented in the broad powers granted to the Security Council to refer and follow up crimes within its competence, In addition to external restrictions due to the hostile attitude of the United States of America to the presence of the Court, which feared that its leaders would be subject to the jurisdiction of the court, As it imposed its hegemony on its regime and gave it a political character, especially the signing of bilateral agreements to promote impunity.
