Main Article Content
Abstract
The employment contract is one of the most important contracts of a social and economic nature, as labor relations often have an impact on the social and economic entity of the state. At the international level, the United Nations approved the Universal Declaration of Human Rights in 1948, and among these rights it endorsed in that declaration the right to work. In Jordan, the provisions of the Labor Law regulated the leaves of working women in Articles (67, 70, and 71) of the Jordanian Labor Law, and in Egypt they were regulated in Articles (91, 93, and 94) of the Egyptian Labor Law.
Accordingly, this research paper studied the position of the Jordanian legislator regarding the vacations for working women, and we followed to achieve this the comparative analytical descriptive approach, by stating the position of the Jordanian legislator with the position of the Egyptian legislator in that, in addition to the statement of the position of the Maternity Protection Convention for the year 2000, and we concluded as a result that the standard The entitlement to the leaves granted to a working woman is a pregnancy or her condition of a woman, and the legislator does not consider whether this pregnancy was through a legitimate marriage or not, and therefore the leave is linked to maternity and not to marriage; Likewise, the Jordanian legislator had a different position in his protection of working women, as the Egyptian legislator was better than his Jordanian counterpart with regard to determining the durations of these leaves, as the periods prescribed in the Egyptian Labor Law were in favor of working women more than the periods prescribed in the Jordanian Labor Law. Others The Jordanian labor law was better than the Egyptian one in dealing with some of the conditions related to these leaves, such as setting an upper limit on the number of times to obtain them, or requiring the passage of a certain period in the service of the employer, as in maternity leave, and God is the guardian of success.
