The Malikis’ Ways in Reasoning out the Jurisprudential Financial Transaction

Abstract

The speed of economic changes and the people's need for jurisprudential fatwas related with their new financial transactions pushed the ummah's jurists to exert their effort to state the rules of their doctrines in light of contemporary challenges. The Maliki jurists had used different methods to reason out their rules on matters of jurisprudence of transactions. They also expanded in using some rules and principles, and excelled in taking into account the people’s interests. This study’s question is: what are Malikis’ methods used in reasoning out the matters of transactional jurisprudence? As a result; the Malikis in their reasoning based on reformist consideration and the flexibility of their doctrine's origins and their capacity to accommodate new coming down issues.
