Abstract

Forced sterilization related to armed conflict is considered a serious and gross violation of the rules of international humanitarian law. It is an infringement on person’s dignity and physical and bodily integrity. Therefore, international criminal law stipulates its criminalization, and that its violators should be prosecuted and pursued so that they will not escape punishment.

On the other hand, it is a violation of the universal and necessary goals that Islamic law came to preserve and protect, which is the goal of preserving the offspring, as it is the only way to preserve the human species and continue the caliphate on the earth and its population.

This article attempts to clarify the Islamic position on forced sterilization related to armed conflict compared to international criminal law as a crime against humanity.
