The investigator of Al-Manatt in Contemporary Financial Transactions

Abstract

The realisation of the Manatt is a great diligent path. This paper tries to consider the case of the investigator of the Manatt in contemporary financial issues, is he the Al-Faqih, after visualising the issue accurately, since the basis for diligence in deriving rulings that are entrusted to diligent Faqihs? Or is it for the expert who has the full knowledge in the field to verify the criteria?. This research concluded that the process of verifying the Manatt is the job of the diligent Faqihs, with the obligation of the Al-Faqih to refer to the expert in matters in which the investigation of the criterion depends on experience. Besides, the expert does not have the right to investigate the issue under any circumstances, but his role is limited to clarifying the facts of the issues.
