Abstract

the Algerian legislator organized electronic commercial transactions under law no 18/05 on electronic commerce, these transactions are concluded through electronic communications and are often carried out in the form of an electronic consumption contract, The latter created many problems due to its special nature, including the problems mentioned in this study, which is known as “Problem of shortcomings of will and their on the electronic consumption contract in accordance with law 18/05 on electronic commerce” the Algerian legislator defended the issuance of the law which did not address all issues related to, and particularly, shortcomings in the framework of electronic consumer contracts, leaving the problems that were not regulated by the general rules, this study was made to show the extent to which the Algerian legislator, through the electronic commerce law, addressed the flaws in the electronic consumption contract, and the outcome of this contract after it was affected by a lack of will.
