Abstract

This research illustrates an important question of international relations related to the contemporary Palestinian political reality, namely, the negotiation with the Jews who have invaded the land of Palestine. The two researchers start with clarifying the concept of negotiation and its relevant terms. The study then explains the legal objectives that should be achieved by the process of the ongoing negotiations with the Jews.

The study also explains the legal controls of the process of negotiations that preserve the interests of the Muslim community. The study sets the controls of selecting the member of the negotiating delegation professionally and personally, and then controls on the management of the negotiation file, as well as controls related to the issue under negotiation.

The researchers reached a number of findings, the most important of which are: The reasons for negotiations in the Palestinian reality are multiple, including the political reasons, such as the consensus on governance, and including running the life matters for the population. Originally, negotiations are prohibited, according to what Allah, Almighty, says in the Holy Quran, “Allah only forbids you, with regard to those who fight you for (your) Faith, and drive you out of your homes, and support (others) in driving you out, from turning to them (for friendship and protection). It is sçuch as turn to them (in these circumstances), that do wrong.”, Yet it is permissible for the Palestinians - for necessity - to conclude with the Jewish occupation agreements of cooperation for the management of peoples’ affairs , such as negotiating the opening of the crossings and borders, and the limits of necessity should not be exceeded.
