Abstract

Every law in terms of absorption has aspects that remain omitted or referred to only، or not addressed due to the necessity of detail required by codification، which usually suffices with the basics، and ignores some details، in order to be satisfied with referring them to an original or source found in or approved by the law. And the Algerian Family Code، given that most of its provisions are derived from Islamic Sharia، chose to refer the silent about it to its provisions، in Article 222 of it، which states: “Everything that is not stipulated in this law is referred to the provisions of Islamic Sharia.” This referral is insufficient in explaining some aspects of the law، especially those that were not derived from Islamic law in originality or text. He has to refer to the provisions of Islamic Sharia، as it is a legal issue in every aspect.
